Kokomo Solar I: Superfund Site Redevelopment

Siting, Planning, Compliance and Due Diligence Solutions

When Inovateus Solar planned to develop a 7 MW project on a former Superfund site in Kokomo, Indiana it required management of additional considerations due to site conditions and restrictions placed on property development by the U.S. EPA. Adhering to EPA requirements could increase construction costs and difficulty without careful planning.

To assist the client with compliance during construction, TRC prepared and negotiated a Contaminant Containment and Contingency Plan with the EPA and the Indiana Department of Environmental Management. The plan outlined methodologies to allow solar farm construction without compromising the surficial direct contact barrier covering the entire site. TRC also assisted the client with compliance inspections and engagement with local, State and Federal regulatory agencies throughout construction. In addition to planning services, TRC also provided:

  • Site plan review assistance and engagement with local regulatory agencies
  • Solar panel layout planning assistance based on likely permitting sensitivities and sequencing requirements
  • Soil erosion and sedimentation control design and permit
  • Environmental due diligence to support obtaining project financing through Alterra Power
  • TRC also negotiated a ‘comfort letter’ with the EPA for the project to support obtaining financing partners and liability protection for the project against any future cleanup costs.
