Neuf types d’installations assujetties à la règle proposée
Le 26 janvier 2024 (89 FR 5318), l’EPA a proposé des règles pour mettre en œuvre le programme de redevance sur les émissions de déchets (WEC) pour les installations qui dépassent un seuil d’émissions de déchets. Le tableau suivant résume les neuf types d’installations assujetties à la règle et les valeurs d’intensité de méthane des déchets connexes utilisées pour calculer le seuil.

Calcul des quantités d’émissions de déchets et des redevances
Pour calculer le seuil d’émissions de déchets pour chaque installation en tm, le débit de gaz naturel (milliers de pieds cubes standard ou Mscf) est multiplié par l’intensité du méthane propre à l’industrie et la densité du méthane (0,0192 mt/Mscf). Pour les installations de production sans ventes de gaz naturel, le seuil d’émissions de déchets est déterminé en multipliant la mesure de l’intensité pétrolière de 10 mt méthane/million de barils de pétrole par le débit de pétrole en millions de barils (bbl).
Les émissions applicables à l’installation sont déterminées en soustrayant le seuil d’émissions de déchets calculé des émissions de méthane de l’installation, tel qu’il est déclaré en vertu de la sous-partie W. Les émissions applicables à l’installation sont positives si elles dépassent le seuil d’émissions de déchets et négatives si elles sont inférieures au seuil d’émissions de déchets. Les émissions dépassant le seuil sont assujetties au CM, qui est de 900 $/tm en 2024, de 1 200 $/tm en 2025 et de 1 500 $/tm par la suite. Les frais du WEC seront versés au département du Trésor des États-Unis par voie électronique. Tel que proposé, le CTE touchera près de 2 200 installations pétrolières et gazières et entraînera des paiements estimés à 770 millions de dollars en 2025 pour se conformer à la règle.
Comme l’énonce la loi, la règle proposée permet la compensation des émissions. Les installations sous propriété ou contrôle communs au 31 décembre pour l’année de déclaration seraient en mesure d’additionner les émissions pour calculer le CSM net. La compensation est autorisée à la fois au sein des segments de l’industrie et entre les segments de l’industrie. La règle proposée comprend également des exemptions légales pour les installations de production qui dépassent le seuil d’émissions de déchets si ces émissions sont causées par des retards déraisonnables en matière de permis qui répondent à des critères spécifiques. Les émissions de méthane provenant des puits de pétrole et de gaz qui ont été bouchés et fermés au cours de l’année de déclaration sont également exemptées du calcul du CME.

Répercussions sur l’industrie pétrolière et gazière
Il est important de noter que les révisions proposées par l’EPA à la sous-partie W de la partie 98 du 40 CFR le 1er juin 2022 (86 FR 36920) ont été révisées pour tenir compte des exigences du CFM le 1er août 2023 (88 FR 50282). Les règles finales de la sous-partie W fondées sur ces révisions précédemment proposées n’ont pas encore été promulguées. Malheureusement, certains aspects des révisions proposées précédemment présentent des défis pour l’industrie pétrolière et gazière. Par exemple, les révisions proposées comprennent de nouveaux coefficients d’émission qui, dans de nombreux cas, entraîneront une augmentation des émissions de gaz à effet de serre (GES) déclarées même s’il n’y a pas eu de changement dans l’exploitation de l’installation. Ce problème est aggravé par le fait que la règle proposée ne tient pas facilement compte de l’évolution rapide de la technologie de mesure. Par conséquent, l’industrie pétrolière et gazière est effectivement limitée par l’utilisation d’une technologie de mesure du méthane de pointe pour démontrer empiriquement que les émissions de GES sont en fait inférieures à celles résultant du calcul des facteurs d’émission.

Le dernier jour pour s’inscrire à l’avance pour prendre la parole à l’audience sera le 7 février 2024. Le 9 février 2024, l’EPA publiera un ordre du jour général qui énumérera les orateurs pré-enregistrés dans un ordre approximatif à https://www.epa.gov/inflation-reduction-act/methane-emissions-reduction-program.

The dominant trend in improving the efficiency and profitability of the logistics and supply chain industry will continue to be achieved through automation. Environmental, social and governance (ESG) issues can be important considerations for investments in this sector due to potential reputational risks for the acquiring entity. Key issues include negative publicity surrounding the perception of job elimination, as well as the procurement of specialty materials required to produce batteries and other components of autonomous robots. The recycling or responsible disposal at the end of the life of the product is also a key focus especially in Europe. TRC was asked to provide ESG risk screening for a foreign auto manufacturer’s investment in a U.S.-based autonomous robotics company. A two-step approach was taken to access the risks associated with this target. The first step evaluated the inherent risks of the target company’s sector based on its geographical spread and operations using public information like the Sustainability Accounting Standards Board (SASB) and the CDC Investment Works Toolkit. The second step involved deeper analysis of ESG risk assessments & insights based on a review of specific controls that the company uses to manage its risks. This included a questionnaire, reviewing company documents and programs, and interviewing company representatives.
