Neuf types d\u2019installations assujetties \u00e0 la r\u00e8gle propos\u00e9e<\/h2>\n

Le 26 janvier 2024 (89 FR 5318), l\u2019EPA a propos\u00e9 des r\u00e8gles pour mettre en \u0153uvre le programme de redevance sur les \u00e9missions de d\u00e9chets (WEC) pour les installations qui d\u00e9passent un seuil d\u2019\u00e9missions de d\u00e9chets. Le tableau suivant r\u00e9sume les neuf types d\u2019installations assujetties \u00e0 la r\u00e8gle et les valeurs d\u2019intensit\u00e9 de m\u00e9thane des d\u00e9chets connexes utilis\u00e9es pour calculer le seuil. <\/p>\n\n\n\nSegment <\/p>\n\n\n\n\nCompression <\/p>\n\n\n\n\n

Calcul des quantit\u00e9s d\u2019\u00e9missions de d\u00e9chets et des redevances<\/h3>\n

Pour calculer le seuil d\u2019\u00e9missions de d\u00e9chets pour chaque installation en tm, le d\u00e9bit de gaz naturel (milliers de pieds cubes standard ou Mscf) est multipli\u00e9 par l\u2019intensit\u00e9 du m\u00e9thane propre \u00e0 l\u2019industrie et la densit\u00e9 du m\u00e9thane (0,0192 mt\/Mscf). Pour les installations de production sans ventes de gaz naturel, le seuil d\u2019\u00e9missions de d\u00e9chets est d\u00e9termin\u00e9 en multipliant la mesure de l\u2019intensit\u00e9 p\u00e9troli\u00e8re de 10 mt m\u00e9thane\/million de barils de p\u00e9trole par le d\u00e9bit de p\u00e9trole en millions de barils (bbl). <\/p>\n

Les \u00e9missions applicables \u00e0 l\u2019installation sont d\u00e9termin\u00e9es en soustrayant le seuil d\u2019\u00e9missions de d\u00e9chets calcul\u00e9 des \u00e9missions de m\u00e9thane de l\u2019installation, tel qu\u2019il est d\u00e9clar\u00e9 en vertu de la sous-partie W. Les \u00e9missions applicables \u00e0 l\u2019installation sont positives si elles d\u00e9passent le seuil d\u2019\u00e9missions de d\u00e9chets et n\u00e9gatives si elles sont inf\u00e9rieures au seuil d\u2019\u00e9missions de d\u00e9chets. Les \u00e9missions d\u00e9passant le seuil sont assujetties au CM, qui est de 900 $\/tm en 2024, de 1 200 $\/tm en 2025 et de 1 500 $\/tm par la suite. Les frais du WEC seront vers\u00e9s au d\u00e9partement du Tr\u00e9sor des \u00c9tats-Unis par voie \u00e9lectronique. Tel que propos\u00e9, le CTE touchera pr\u00e8s de 2 200 installations p\u00e9troli\u00e8res et gazi\u00e8res<\/a> et entra\u00eenera des paiements estim\u00e9s \u00e0 770 millions de dollars en 2025 pour se conformer \u00e0 la r\u00e8gle. <\/p>\n

Comme l\u2019\u00e9nonce la loi, la r\u00e8gle propos\u00e9e permet la compensation des \u00e9missions. Les installations sous propri\u00e9t\u00e9 ou contr\u00f4le communs au 31 d\u00e9cembre pour l\u2019ann\u00e9e de d\u00e9claration seraient en mesure d\u2019additionner les \u00e9missions pour calculer le CSM net. La compensation est autoris\u00e9e \u00e0 la fois au sein des segments de l\u2019industrie et entre les segments de l\u2019industrie. La r\u00e8gle propos\u00e9e comprend \u00e9galement des exemptions l\u00e9gales pour les installations de production qui d\u00e9passent le seuil d\u2019\u00e9missions de d\u00e9chets si ces \u00e9missions sont caus\u00e9es par des retards d\u00e9raisonnables en mati\u00e8re de permis qui r\u00e9pondent \u00e0 des crit\u00e8res sp\u00e9cifiques. Les \u00e9missions de m\u00e9thane provenant des puits de p\u00e9trole et de gaz qui ont \u00e9t\u00e9 bouch\u00e9s et ferm\u00e9s au cours de l\u2019ann\u00e9e de d\u00e9claration sont \u00e9galement exempt\u00e9es du calcul du CME. <\/p>\n

R\u00e9percussions sur l\u2019industrie p\u00e9troli\u00e8re et gazi\u00e8re<\/h3>\n

Il est important de noter que les r\u00e9visions propos\u00e9es par l\u2019EPA \u00e0 la sous-partie W de la partie 98 du 40 CFR le 1er juin 2022 (86 FR 36920<\/a>) ont \u00e9t\u00e9 r\u00e9vis\u00e9es pour tenir compte des exigences du CFM le 1er ao\u00fbt 2023 (88 FR 50282<\/a>). Les r\u00e8gles finales de la sous-partie W fond\u00e9es sur ces r\u00e9visions pr\u00e9c\u00e9demment propos\u00e9es n\u2019ont pas encore \u00e9t\u00e9 promulgu\u00e9es. Malheureusement, certains aspects des r\u00e9visions propos\u00e9es pr\u00e9c\u00e9demment pr\u00e9sentent des d\u00e9fis pour l\u2019industrie p\u00e9troli\u00e8re et gazi\u00e8re. Par exemple, les r\u00e9visions propos\u00e9es comprennent de nouveaux coefficients d\u2019\u00e9mission qui, dans de nombreux cas, entra\u00eeneront une augmentation des \u00e9missions de gaz \u00e0 effet de serre (GES) d\u00e9clar\u00e9es m\u00eame s\u2019il n\u2019y a pas eu de changement dans l\u2019exploitation de l\u2019installation. Ce probl\u00e8me est aggrav\u00e9 par le fait que la r\u00e8gle propos\u00e9e ne tient pas facilement compte de l\u2019\u00e9volution rapide de la technologie de mesure. Par cons\u00e9quent, l\u2019industrie p\u00e9troli\u00e8re et gazi\u00e8re est effectivement limit\u00e9e par l\u2019utilisation d\u2019une technologie de mesure du m\u00e9thane de pointe pour d\u00e9montrer empiriquement que les \u00e9missions de GES sont en fait inf\u00e9rieures \u00e0 celles r\u00e9sultant du calcul des facteurs d\u2019\u00e9mission. <\/p>\n <\/div>\n <\/div>\n<\/section>\n\n\n

Le 9 f\u00e9vrier 2024, l\u2019EPA publiera un ordre du jour g\u00e9n\u00e9ral qui \u00e9num\u00e9rera les orateurs pr\u00e9-enregistr\u00e9s dans un ordre approximatif \u00e0 https:\/\/www.epa.gov\/inflation-reduction-act\/methane-emissions-reduction-program<\/a>. <\/p>\n

On September 22, 2021, the New Jersey Department of Environmental Protection (NJDEP) Commissioner announced the issuance of Administrative Order (AO) No. 2021-25 to implement New Jersey\u2019s Environmental Justice (EJ) Law. This order is effective immediately, and applicants seeking to site new major source facilities, renew major source permits or expand existing facilities with major source permits (e.g., Title V air permits) in overburdened communities are affected. There are more than 4.5 million people that live within 331 municipalities that are overburdened communities in the state of New Jersey.\r\nThe Administrative Order requires an enhanced public participation process that requires facilities to:\r\n\r\n\tHold a public hearing meeting as determined by the Environmental Justice Law.\r\n\tTo the extent consistent with applicable law, have a public comment period that is a minimum of sixty (60) days. If there is written request from members of the respective overburdened community, the public comment period may be extended by thirty (30) days to provide information related to \u201cinformation regarding existing conditions within the overburdened community and potential facility-wide environmental and public health stressors that could result in adverse impacts upon the overburdened community were the regulated activity approved.\u201d\r\n\tRespond to and address the concerns raised by individuals from the overburdened community during the public comment period, which may include the need to perform additional analysis as deemed necessary by the NJDEP.\r\n\tSolicit concerns from the overburdened community regarding environmental or public health stressors posed by the facility.\r\n\tAdhere to special conditions placed on permits approved by the NJDEP. Special conditions may be placed to avoid or minimize public health stressors to the maximum extent allowed by law.\r\n\tNJDEP has the authority to reopen or further extend the public comment period on a case-by-case basis, as consistent with applicable law and statues.\r\n\r\nTitle V permit holders in overburdened communities in New Jersey must take steps to address new and multi-faceted environmental justice regulations and should do so in an effective manner to avoid business difficulties and manage public relations issues. This AO has the potential to significantly impact project schedules for new projects or facility expansions. Therefore, identifying EJ-related concerns during the planning phase is critical to a successful project and benefits both the business and the community.<\/p>\n <\/div>\n

TRC was recently awarded a Yahara WINS grant to develop a pilot scale simple aeration method for removing phosphorous from the discharge of manure digesters. The grant application was developed and submitted by: Bob Stanforth, Alyssa Sellwood, Mike Ursin, Ted O\u2019Connell, Ken Quinn, and John Rice, who are members of multiple TRC CORE teams.<\/p>\n <\/div>\n
