Environmental Protection Agency<\/em><\/a>. In the interim, the U.S. EPA and U.S. ACOE will interpret the phrase \u201cwaters of the United States\u201d consistent with the Supreme Court\u2019s decision in\u00a0<em>Sackett.<\/em><\/p>\n class=\"half-and-half-text__wrapper js-animated-content animated-content\">\n                                        <h2>Impacts for Wetlands Development Projects<\/h2>\n<p>In the Sackett decision, the U.S. Supreme Court noted that the U.S. EPA \u201chas no \u2018statutory basis\u2019 to impose the \u2018significant nexus\u2019 test and held that federal jurisdiction over wetlands applies only to those wetlands that have \u201ccontinuous surface connection to bodies that are \u2018waters of the United States\u2019 in their own right, so that there is no clear demarcation between \u2018waters\u2019 and wetlands.\u201d This decision limits the U.S. EPA and U.S. ACOE jurisdiction over wetlands to\u00a0<strong>only those<\/strong>\u00a0<strong>wetlands that have a<\/strong>\u00a0<strong>continuous surface connection to otherwise-defined WOTUS<\/strong>\u00a0\u2013 a decision that will have far-reaching implications on current and future development projects.<\/p>\n<p><strong>The\u00a0<em>Sackett<\/em>\u00a0interpretation will apply nationally<\/strong>, including in those states for which an injunction on the application of the \u201cRevised  <\/div>\n\n                            <div class=\"col-lg-12 js-animated-content animated-content\">\n                    <h2>History of the WOTUS Definition<\/h2>\n<p>On January 18, 2023, the U.S. EPA and the U.S. ACOE published the \u201c<a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/01\/18\/2022-28595\/revised-definition-of-waters-of-the-united-states\">Revised Definition of Waters of the United States<\/a>\u201d (the January 2023 Rule) in the Federal Register. The Rule took effect on March 20, 2023, except in those 27 states that had contested the January 2023 Rule in court and for which the court had issued a preliminary injunction against implementation of the Rule.<\/p>\n<p><a href=\"https:\/\/www.federalregister.gov\/documents\/2023\/01\/18\/2022-28595\/revised-definition-of-waters-of-the-united-states\">The January 2023 Rule<\/a>\u00a0included impoundments, tributaries and wetlands with\u00a0<strong>significant nexus<\/strong>\u00a0to traditional navigable waters, the territorial seas, or interstate waters\u2014i.e., those waters that \u201ceither alone or in combination with similarly situated waters in the region, significantly affect the chemical, physical, or biological integrity\u201d of traditional navigable waters, the territorial seas, or interstate waters.<\/p>\n                <\/div>\n                                <\/div>\n\n                    <\/div>\n            <\/div>\n<\/section>\n<!-- End Block: acf\/wysiwyg -->\n\n<!-- Start Block: acf\/wysiwyg -->\n\n<section class=\"wysiwyg section-padding bg-white-fog\">\n    <div class=\"container-fluid\">\n                    <div class=\"wysiwyg__wrapper\">\n        \n        <div class=\"row\">\n                        <div class=\"col-lg-12\">\n                                                                                \n                                                <\/div>\n\n                            <div class=\"col-lg-12 js-animated-content animated-content\">\n                    <h2>Implications of the\u00a0<em>Sackett<\/em>\u00a0Decision<\/h2>\n<p>As a result of the Supreme Court\u2019s decision in\u00a0<em>Sackett<\/em>, the January 2023 Rule becomes unworkable since the definition of WOTUS in the Rule relies heavily on the \u201csignificant nexus\u201d test to identify wetlands and other water bodies that will be subject to regulation under the Clean Water Act (CWA).<\/p>\n<p><a href=\"https:\/\/www.trccompanies.com\/fr\/insights\/u-s-epa-and-army-corps-of-engineers-to-develop-revised-rule-to-define-waters-of-the-united-states\/#_ftnref1\" name=\"_ftn1\"><\/a><\/p>\n<blockquote>\n<p>The decision in Sackett clearly rejects the concept of \u201csignificant nexus\u201d in favor of including wetlands in CWA coverage only if \u201cthere is a continuous surface connection\u201d to other defined WOTUS such that the wetlands are indistinguishable from the identified WOTUS.<\/p>\n<\/blockquote>\n<p>The\u00a0<em>Sackett\u00a0<\/em>decision restricts the U.S. EPA\u2019s and U.S. ACOE\u2019s ability to regulate certain types of wetlands and streams. The U.S. EPA and the U.S. ACOE have been successful in obtaining a stay for two of the three ongoing cases regarding the January 2023 Rule pending the planned publication of a revised definition of WOTUS in September 2023. However, the U.S. EPA\u2019s stay motion in the\u00a0<a href=\"chrome-extension:\/\/efaidnbmnnnibpcajpcglclefindmkaj\/https:\/www.supremecourt.gov\/opinions\/21pdf\/20-1530_n758.pdf\"><em>State of West Virginia v. EPA et. al.<\/em><\/a>\u00a0case was met with motions for summary judgment by business intervenors. The Agencies have stated that they will revise the WOTUS definition with \u201csurgical precision\u201d to address the\u00a0<em>Sackett<\/em>\u00a0decision.<\/p>\n<h3>TRC\u2019s Recommendations<\/h3>\n<ul>\n<li>If you have a permit, certification, or permit application under review that is affected by the WOTUS interpretation and\u00a0<em>Sackett\u00a0<\/em>decision, TRC recommends discussing the implication of the recent U.S. EPA and U.S. ACOE position with your regulating entity to determine if any changes to the permit, certification, or permit application are needed.<\/li>\n<li>If you have WOTUS that have the potential to change the status from the 2023 \u201cRevised Definition of Waters of the United States\u201d Rule definition to the\u00a0<em>Sackett<\/em>\u00a0interpretation, TRC recommends re-evaluating the applicability of WOTUS to the site and identifying affected permits and certifications.<\/li>\n<li>Evaluate applicable State requirements as they may be more stringent than the federal regulatory requirements.<\/li>\n<li>Litigation regarding the WOTUS definition is ongoing. Stay abreast of additional future changes to the WOTUS definition interpretation by the Courts.<\/li>\n<\/ul>\n                    <\/div>\n    <\/div>\n<\/section>\n<!-- End Block:
