CFATS requirements apply to facility owners and operators that possess, consume, sell or create various chemicals of interest (COI) that could be used in an act of terror.<\/p>\n<p>Understanding these regulations and how they work \u2013 along with similar rules from other federal agencies \u2013 is vital to developing a sound strategy for keeping chemicals safe and secure and minimizing risk.<\/p>\n<p>Roughly 300 chemicals of interest are categorized by DHS according to the kind security threat they pose:<\/p>\n                            <\/div>\n                        <\/div>\n                                                                                <div class=\"col-lg-4 columns\">\n                                                        <div class=\"js-animated-content animated-content\">\n                                <ul>\n<li><strong>Release:<\/strong> Covers chemicals that pose a danger to the public if a terrorist act contributes to a sudden release at a chemical facility. But the issue gets even trickier due to overlap with similar regulations from the Environmental Protection Agency and the Occupational Safety and Health Administration that address accidental incidents involving chemicals.<\/p>\n<p>EPA\u2019s\u00a0<a href=\"https:\/\/www.epa.gov\/rmp\" target=\"_blank\" rel=\"noopener noreferrer\">Risk Management Plans (RMP) Rule<\/a>\u00a0requires facilities using extremely hazardous substances to develop a risk management plan that:<\/p>\n<ul>\n<li>Identifies the potential effects of a chemical accident<\/li>\n<li>Outlines the steps the facility is taking to prevent an accident<\/li>\n<li>Spells out emergency response procedures should an accident occur<\/li>\n<\/ul>\n<p>Meanwhile, OSHA\u2019s\u00a0<a href=\"https:\/\/www.osha.gov\/SLTC\/processsafetymanagement\/\" target=\"_blank\" rel=\"noopener noreferrer\">Process Safety Management (PSM) program<\/a>\u00a0contains requirements for preventing or minimizing the consequences of catastrophic releases of toxic, reactive, flammable or explosive chemicals.<\/p>\n<p>Many substances are regulated by more than one of the three agencies, creating a complex regulatory soup for companies and organizations using or storing the chemicals.<\/p>\n                    <\/div>\n    <\/div>\n<\/section>\n<!-- End Block: acf\/innerpage-half-text-half-image -->\n\n<!-- Start Block: acf\/wysiwyg -->\n\n<section class=\"wysiwyg section-padding bg-white-fog\">\n    <div class=\"container-fluid\">\n        \n        <div class=\"row\">\n                        <div class=\"col-lg-12\">\n                                    <div class=\"wysiwyg__columns-text-top\">\n                        <div class=\"row js-animated-content animated-content\">\n                            <div class=\"col-lg-8 js-animated-content animated-content\">\n                                <div class=\"option-links\">\n                                    <ul>\n                                                                            <\/ul>\n                                <\/div>\n                                <h2>One Size Does Not Fit All<\/h2>\n<p>Each regulatory program establishes minimum threshold quantities for each regulated chemical. If a facility exceeds the threshold quantity, it is subject to the regulations. These threshold levels often align \u2013 but not always.<\/p>\n                                \n                            <\/div>\n                            <div class=\"col-lg-4\">\n                                                            <\/div>\n                        <\/div>\n                    <\/div>\n                            <\/div>\n\n                                                                        <div class=\"col-lg-4 \">\n                                                        <div class=\"js-animated-content animated-content\">\n                                <p>For example, anhydrous ammonia (CAS 7664-41-7) is listed as a toxic chemical under all three programs:<\/p>\n<ul>\n<li>PSM \u2013 10,000 pounds<\/li>\n<li>RMP \u2013 10,000 pounds<\/li>\n<li>CFATS \u2013 10,000 pounds (Release \u2013 Toxic Security Issue)<\/li>\n<\/ul>\n<p>For a substance like chlorine, however, CFATS goes beyond RMP or PSM to address an additional security threat:<\/p>\n                            <\/div>\n                        <\/div>\n                                                                                <div class=\"col-lg-4 columns\">\n                                                        <div class=\"js-animated-content animated-content\">\n                                <ul>\n<li>PSM \u2013 2,500 pounds<\/li>\n<li>RMP \u2013 2,500 pounds<\/li>\n<li>CFATS \u2013 2,500 pounds (Release \u2013 Toxic) and 500 pounds (9.77 percent minimum concentration.
