The 2015 rule was considered by many to be vague in its definition of protected waters, which triggered the flood of lawsuits \u2013 including some that ended up before the U.S. Supreme Court.<\/p>\n                <\/div>\n                                <\/div>\n\n                    <\/div>\n            <\/div>\n<\/section>\n<!-- End Block: acf\/wysiwyg -->\n\n<!-- Start Block: acf\/wysiwyg -->\n\n<section class=\"wysiwyg section-padding bg-light-gradient\">\n    <div class=\"container-fluid\">\n        \n        <div class=\"row\">\n                        <div class=\"col-lg-12\">\n                                                                                \n                                                <\/div>\n\n                                                                        <div class=\"col-lg-4 \">\n                                                        <div class=\"js-animated-content animated-content\">\n                                <h2>Overview of the New Rule<\/h2>\n<p><a href=\"https:\/\/www.epa.gov\/sites\/production\/files\/2018-12\/documents\/wotus_2040-af75_nprm_frn_2018-12-11_prepublication2_1.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">The new rule<\/a>\u00a0was initiated by Executive Order 13778 in 2017, which authorized the EPA and the assistant secretary of the Army to review 2015\u2019s\u00a0<a href=\"https:\/\/www.federalregister.gov\/documents\/2015\/06\/29\/2015-13435\/clean-water-rule-definition-of-waters-of-the-united-states\" target=\"_blank\" rel=\"noopener noreferrer\">Clean Water Rule<\/a>\u00a0\u2013 specifically the portion defining \u201cnavigable waters\u201d \u2013 and propose revisions. The new rule would establish a new definition of protected waters that clarifies federal authority under the Clean Water Act (CWA) and provide greater flexibility to states and tribes to manage their land and water resources. The rule could also take into account court rulings, so that future court challenges could be avoided.<\/p>\n<p>The revised rule is intended to establish bright lines between federal and state waters and eliminate case-by-case application of the significant nexus test set forth in Associate Justice Anthony Kennedy\u2019s concurring opinion in\u00a0<em><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/547\/715\/\" target=\"_blank\" rel=\"noopener noreferrer\">Rapanos v. United States<\/a><\/em>. The rule attempts to accomplish this by establishing six types of water bodies that are considered Waters of the United States (WOTUS) and 11 types that aren\u2019t. However, litigation headed to the Supreme Court may change that. The County of Maui in Hawaii was sued by a collection of environmental groups over an underground injection facility that processes and ultimately injects up to 5 million gallons of treated sewage daily.<\/p>\n<p>A study from the University of Hawaii showed in 2012 that effluent from the injection wells was reaching the Pacific Ocean. The U.S. District Court in Hawaii ruled that this type of discharge is subject to regulation under the CWA, a ruling that was upheld by the 9<sup>th<\/sup>\u00a0U.S. Circuit Court of Appeals. The Supreme Court has agreed to hear the case in October.
